OBJECT :
These general conditions apply to the website without restriction or reservation and are intended to define the terms and conditions of any selling carried out from the e-commerce website www.maurusia.com website.
The Maurusia Maurusia are produced and sold by Maurusia SARL, hereinafter referred to as the "Seller", whose legal information is given below. Any order placed on this site assumes that the customer, hereinafter referred to as the "Customer", irrevocably accepts these conditions. To this end, by clicking on the tab "I accept the general conditions of sale" on the order confirmation page, you irrevocably and unequivocally accept and adhere to these general conditions of sale (hereinafter referred to as the "Terms & Conditions”) which we recommend that you read carefully.
MAURUSIA PRODUCTS
The Maurusia Maurusia présentés sur le présent site « Produits » sont des produits issus du terroir du Maroc tous ayant les autorisations ONSSA et dont certains bénéficient d’une certification BIO délivrée par ECOCERT &/ou Maurusia.
The Product offers presented on www.maurusia.com website are valid within the limits of available stocks. In case of unavailability of a product, the customer will be informed accordingly.
SELLING PRICE
The selling prices of the Products are indicated in Dirhams (MAD) all taxes included and are those in force at the time of registration of the order form by the Customer and/or Consultation by the customer.
The Seller reserves the right to modify the selling prices without impacting confirmed orders.
The prices displayed on the online sales platform do not include transport and delivery costs, which are invoiced in addition and this, in accordance with the provisions below in line with minimum order value.
When the order made is intended for foreign countries (outside Morocco), the Customer will be the importer of the Product(s). Customs duties or other local taxes or import duties or government taxes may be payable. These rights and amounts are not the responsibility of the Seller. They will be borne by the customer and are within his full responsibility both in terms of declarations & payments to the competent authorities and bodies of the country. It is therefore recommended to inquire about these aspects with the competent local authorities.
ORDER
The Customer is responsible for the information he provides when registering the order. He verifies the completeness and the conformity of the information he provides when ordering, in particular last name and first name, the exact address of the delivery and the telephone number &/or the email. The Seller cannot be held responsible for input errors or any other errors by the Customer and the resulting consequences (delays or delivery errors, for example). The costs incurred for the reshipment of the order will be borne by the Customer.

VALIDATION OF THE ORDER
At the end of the order process, you are required to click on the “Place Order” tab, by this click you declare to unequivocally accept all of these General Terms and Conditions of Sale fully and without reservation and to validate your order. The data recorded by the site constitutes proof of all transactions between the Customer and the Seller.
Les commandes reçues et confirmées par le Vendeur dans le territoire marocain sont traitées et expédiées dans un délai allant de 24h à 72h maximum à compter de la confirmation de la commande au Client.
PAYMENT
Payments are made in cash on delivery. The other methods of payment will be deployed in the near future.
PROOF OF TRANSACTION
Your acceptance of the general conditions of sale, your validation of the order form as well as the confirmation email of the order form by the Seller constitute irrefutable proof of the existence of a purchase and sale transaction between the Customer and the Seller.
PROTECTION OF PERSONAL DATA
The information requested from you is necessary to process your order and is treated confidentially. The Seller undertakes to comply with the provisions of Law No. 09-08 relating to the protection of individuals with regard to the processing of personal data. The Customer hereby agrees that his personal data may be processed and/or transmitted to third parties within the strict framework of these general conditions of sale.
To this end, the Customer will have the following rights:

– un droit de rectification qui lui permettra de demander la rectification des informations inexactes ou incomplètes ; ;

TERMS AND CONDITIONS OF DELIVERY
Les frais de livraisons sont facturés selon les tarifs en vigueur pour les commandes en deçà de 200dhs pour Casablanca et 250dhs pour les autres villes du Maroc. Au-delà des montants précités, les frais de livraisons sont offerts.
Delivery is made to the address mentioned by the Customer when registering the order form.
The date of delivery of the goods is communicated by the Seller for information purposes only.
Any justified delay, not attributable to the Seller or in the event of force majeure, the delivery of the Product(s) shall not entitle the Customer to damages and/or cancellation of the order. However, in the event of an unusual delay or in the cases mentioned below in the delivery of the Product(s), a detailed and explanatory email will be sent to the Customer in order to keep him informed of the next delivery date.
Les pertes et les sinistres (avarie, produit manquant par rapport au bon de livraison, colis endommagé, produits cassés…) doivent être constatés par écrit
et signé sur le bon de livraison par le Client (ou le réceptionnaire) à la réception du ou des Produits. En outre, ces réserves devront être confirmées par écrit dans les trois (3) jours ouvrés au plus tard suivant la livraison par lettre recommandée avec accusé de réception adressé à Maurusia SARL à l’adresse suivante : Imm6, Rue 6 Octobre, Bd El Massira. Casablanca. Maroc Tel : +212 663 366 266. Dans ce cas, le Vendeur se réserve le droit de procéder à toutes les vérifications qu’il estimerait utiles afin d’évaluer le bien-fondé des réserves et d’y donner la suite qu’il juge opportune.
In the event of default by the Customer for any reason whatsoever, and in particular in the event of his absence at the time of delivery, all initial and additional costs due and incurred by the Seller will remain the responsibility of the Customer. In case of absence of reservation within 7 days of receipt of the product, the latter is considered compliant and no return thereof will be acceptable.
DELIVERY ERROR
Any complaint of delivery error and/or non-conformity of the Products delivered must be made by email or by phone within 24 hours at the latest following the date of delivery.

In the event of a claim established within the time limits, the Seller will carry out the necessary investigations to verify whether an error has actually occurred during the delivery of the Product.

In the absence of a complaint made within the deadlines mentioned above, the Seller cannot be held liable vis-à-vis the consumer.
In the event of a complaint accepted by the Seller, an exchange number for the Product(s) concerned will be communicated to the Customer by e-mail, or by telephone to the consumer.
Il est entendu qu’en cas de retour ou d’échange de Produit, ce dernier doit rester intact, dans son ensemble et dans son emballage d’origine, ne doit aucunement être ouvert, et doit être accompagnés de toutes documentations (Bon de commande, Bon de livraison ou Document de transport) par poste à l’adresse suivante :Maurusia SARL à l’adresse suivante : Imm6, Rue 6 Octobre, Bd El Massira. RESPONSIBILITY
The Seller's liability can only be engaged in the cases provided for by law. Moreover, its liability cannot be engaged in the cases of force majeure mentioned below or when the error or fault has occurred due to the Customer. Moreover, the Seller cannot be held responsible:
- Direct, indirect, consequential or resulting damages from the use or inability to use its services;
- Alteration of data transmissions (for example when the user sees the mention 404, 501 etc. displayed on the site)
LIMITATION OF LIABILITY
1-DAMAGES, LOSSES AND DAMAGES In the event of damage, loss and/or damage suffered by the Product and attributable to the transport and delivery operation, the Seller's liability shall be strictly limited to the value of the Product concerned by such damage, loss or damage.
2- LATE DELIVERY In the event of a delay in delivery attributable to the Seller, duly noted under the conditions of these “CGV”, the compensation due to the Customer by the Seller under its liability is strictly limited to the price of the transport of the Product (duties, taxes and miscellaneous excluded) as paid by the Customer.
GOODS INSURANCE
Les Produits livrés sont réputés être la propriété du Client dès paiement du bon de livraison émis par le Vendeur. Les risques afférents exclusivement au transport et à la livraison réalisée par le Vendeur feront potentiellement l’objet d’une assurance souscrite par celle-ci auprès d’une compagnie d’assurance notoirement solvable.
FORCE MAJEURE
Force majeure means any event affecting and beyond the control of any of the Parties, and in particular, without this list being exhaustive, the cases of strikes, including internal strikes, armed conflicts, riots, accidents, fires, floods, natural disasters, material shortages, tool failures, modification of the legislative or regulatory framework, or any cause beyond the control of the Parties which would make it impossible or excessively onerous to perform its contractual obligations.
In the event of the occurrence of a case of force majeure, the Seller will inform the customer by email or telephone of the event of force majeure and the date on which it hopes to be able to deliver the Product.
RIGHT OF WITHDRAWAL:
1- EXERCISE OF THE RIGHT OF WITHDRAWAL In accordance with the provisions of Law 31-08 relating to consumer protection, the Customer has a right of withdrawal. The Customer has a deadline:
– de sept jours pour exercer son droit de rétractation ;
– de trente jours pour exercer son droit de rétractation, si le fournisseur n’honore pas son engagement de confirmer par écrit les informations. Et cela, sans avoir à se justifier, ni à payer des pénalités, à l’exception, le cas échéant, des frais de retour. Les délais mentionnés à l’alinéa précédent courent à compter de la date de réception du bien ou de l’acceptation de l’offre pour les prestations de services.
1- EXERCISE OF THE RIGHT OF WITHDRAWAL Le droit de rétractation ne peut être exercé pour les contrats suivants
- supply of services whose execution has begun, with the agreement of the consumer, before the end of the period of seven (7) clear days;
- supply of products or services whose price or tariff depends on fluctuations in financial market rates;
- the supply of goods made to the consumer's specifications or personalized or which, by their nature, cannot be returned or are likely to deteriorate or expire rapidly;
The Customer must be informed in the event of failure to perform the contract by the Seller resulting from the unavailability of the product, good or service ordered. If necessary, it is the Seller's responsibility to reimburse, without delay and at the latest, within fifteen (15) days of payment of the sums already paid. After fifteen (15) days, these sums bear interest at the legal rate.

A customer and after-sales service is available to you from Monday to Friday from 8:30 a.m. to 6:30 p.m.

INTELLECTUAL PROPERTY
The entire content of the Maurusia site (illustrations, texts, labels, brands, images, videos) is the property of the Seller. Any partial or total reproduction of the content by any process whatsoever and on any medium is subject to the prior and express authorization of the Seller.
All information, content, files and software offered by our services are protected by Moroccan and international laws concerning intellectual property and copyright. The seller cannot give you permission to copy, display or distribute any content for which you do not own the intellectual property rights.
Any use of these contents in fraud of the rights held by third parties on them constitutes the offense of counterfeiting, severely punished by the Intellectual Property Code. The Seller can in no way be held responsible for the violation by a user of rights held by third parties as a result of the latter's activities on the site.

APPLICABLE LAW – SETTLEMENT OF DISPUTES
These general conditions are governed by Moroccan law. Any dispute arising in connection with the validity, interpretation and execution of these GCS, the Parties shall endeavor to settle their dispute by means of conciliation within thirty (30) days from the notification which would be made to the other Party by the most diligent Party.
In the absence of such conciliation at the end of the said period, all disputes arising from this contractual relationship will be settled by the competent courts of Casablanca.
